LULA X MORO HEARING.

Cristiano Zanin Martins, um dos advogados do ex-presidente Luiz Inácio Lula da Silva (PT), e o juiz federal Sérgio Moro – que é o responsável pelos processos da Operação Lava Jato na primeira instância – discutiram durante a audiência realizada na manhã desta segunda-feira (5).

O bate-boca começou quando o advogado quis fazer uma pergunta ao ex-deputado do Partido Progressista (PP) Pedro Corrêa, ouvido nesta manhã como testemunha de acusação por videoconferência com Recife (PE).

"O senhor vai negar que a testemunha responda a essa questão?", perguntou Cristiano Zanin Martins. O advogado queria saber se Pedro Corrêa confirmava uma afirmação feita em outro depoimento.

Anteriormente, o ex-deputado havia relatado que, quando foi chamado pelo Ministério Público Federal (MPF), em setembro de 2016, lhe foi informado de que faltavam informações para embasar a denúncia contra Lula. Por isso, Corrêa tentou colaborar e testemunhar. Ele fechou acordo de delação premiada com o MPF, mas a colaboração ainda não foi homologada.

Sérgio Moro interveio dizendo que Pedro Corrêa já tinha respondido e ratificado essa questão. O advogado de Lula insistiu e afirmou que a pergunta era relevante e pertinente, e o juiz federal declarou que a defesa estava confundindo a testemunha. "Vossa Excelência que parece que está respondendo no lugar da testemunha", disse Cristiano Zanin Martins.

No momento em que o advogado de Lula citou a condenação de Pedro Corrêa, Sérgio Moro questionou se Martins estava querendo humilhar a testemunha. "É inapropriado", disse o juiz federal. Para Sérgio Moro, a condenação da testemunha se trata de "fatos notórios".

O ex-deputado já foi condenado pela Lava Jato a mais de 20 anos de prisão por crimes como corrupção e lavagem de dinheiro. Atualmente, ele cumpre prisão domiciliar por razões médicas.

O juiz federal então perguntou se o advogado tinha mais alguma pergunta – "sobre fatos" – a fazer. Martins respondeu: "Eu fiz as perguntas. Se as perguntas infelizmente incomodam, eu lamento. Mas eu já fiz as perguntas e não tenho mais perguntas a fazer". A audiência foi encerrada logo em seguida.

Eu não era um desconhecido do ex-presidente Lula'

O ex-deputado disse a Sérgio Moro que estranhou o fato de o ex-presidente Lula ter dito na audiência em que prestou depoimento em Curitiba que não tinha feito nenhuma reunião com ele. Corrêa mostrou um álbum e disse ter fotos de uma das reuniões onde estavam presentes vários políticos, inclusive ele e o ex-presidente Lula.

"Eu gostaria, inclusive, de anexar depois essas fotografias para mostrar ao processo de que eu não era um desconhecido do ex-presidente Lula, como ele afirmou, que não tinha nenhuma relação comigo. Eu vivia no Palácio do Governo e no Palácio do Planalto, porque eu era presidente do partido e, consequentemente, participava pelo menos duas vezes por mês das reuniões do conselho político", declarou o ex-deputado.

Pedro Corrêa também confirmou à promotora do MPF Isabel Cristina Vieira algumas declarações que fez durante um depoimento em setembro de 2016. Uma das questões relembradas e confirmada pelo ex-deputado foi de que houve pagamentos de propina nos contratos da Refinaria Presidente Getúlio Vargas (Repar) e da Refinaria Abreu e Lima (RNEST) para o Partido Progressista.

"Sim. Esses contratos tinham recursos que vinham para o partido tanto na RNEST quanto da Repar", respondeu o ex-parlamentar.

Ação penal

Nesta ação penal, o MPF acusa o ex-presidente Lula de receber como propina um terreno onde seria construída a nova sede do Instituto Lula e um imóvel vizinho ao apartamento do petista, em São Bernardo do Campo (SP).

De acordo com a força-tarefa da Lava Jato, esses imóveis foram comprados pela Odebrecht em troca de contratos adquiridos pela empresa na Petrobras.

Lula responde, neste processo, por corrupção passiva e lavagem de dinheiro. Outras sete pessoas também são rés. A ex-primeira dama Marisa Letícia chegou a ser acusada. Contudo, Moro decretou a impossibilidade de puni-la. Marisa Leticia morreu em fevereiro deste ano.

O ex-presidente nega as acusações, e o Grupo Odebrecht tem afirmado que tem colaborado com as investigações. Instituto Lula afirmou que "nunca teve outra sede a não ser o sobrado onde funciona até hoje, adquirido em 1990 pelo Instituto de Pesquisas e Estudos do Trabalhador (Ipet)".

Denúncia do MPF

Conforme o MPF, a Construtora Norberto Odebrecht pagou propina a Lula via aquisição do imóvel onde seria construída nova sede do Instituto Lula, em São Paulo. O valor, até novembro de 2012, foi de R$ 12.422.000, afirmam os procuradores.

O valor consta, segundo a força-tarefa a Lava Jato, em anotações de Marcelo Odebrecht, planilhas apreendidas durante as investigações e dados obtidos a partir de quebra de sigilo.

A denúncia do MPF afirma também que o ex-presidente recebeu, como vantagem indevida, a cobertura vizinha à residência onde vive em São Bernardo do Campo, interior de São Paulo. De acordo com
