Former Finance Minister Antonio Palocci tries to negotiate, in an
award-winning agreement, that his sentence be served in a year of house
arrest and that his testimony be focused on bankers and businessmen, in

Preso desde setembro de 2016, o petista tem se dedicado, no último mês, à elaboração de sua proposta de acordo com a Procuradoria-Geral da República e a força tarefa da Lava Jato em Curitiba.
Para ter sua delação aceita pelos investigadores, Palocci decidiu revelar os detalhes de operações supostamente irregulares cometidas pelo ex-presidente e um dos donos do BTG Pactual, André Esteves, e o ex-dono do Pão de Açúcar Abílio Diniz.
No caso de Esteves, o ex-ministro promete explicar supostas vendas de medidas provisórias no Congresso para bancos privados, nos quais, segundo Palocci, o banqueiro esteve envolvido.
Sobre Abílio, o petista diz, segundo a Folha apurou, que pode detalhar suposta manobra para tentar mantê-lo no controle do Grupo Pão de Açúcar, em meio à disputa com a francesa Casino. O imbróglio, que durou dois anos, não deu certo e culminou na saída de Abílio do conselho do grupo, em 2013.
Como a Casino contava com o apoio informal de Fernando Pimentel (PT), à época ministro do Desenvolvimento de Dilma, Abílio contratou Palocci para garantir influência a seu favor. A informação foi confirmada à Folha por integrantes das tratativas do acordo.
O Grupo Pão de Açúcar fez pagamentos à Projeto, empresa de Palocci, por meio do escritório do advogado e ex-ministro da Justiça Márcio Thomaz Bastos, morto em 2014. Notas divulgadas em 2015 pelas partes confirmam as transações. Relatório do Coaf, com dados de 2008 a 2011, mostra que Bastos foi o segundo maior cliente da consultoria de Palocci, com repasses de R$ 5,5 milhões.
Em 2015, a Projeto divulgou nota na qual afirma que os pagamentos tiveram como origem o grupo Pão de Açúcar, que contratou o ex-ministro para que ajudasse na fusão com as Casas Bahia.
Além de citar integrantes do setor privado, o que poderia abrir novo flanco de investigação, Palocci diz que explicará esquema de corrupção no Carf (Conselho Administrativo de Recursos Fiscais), o que poderia unir as operações Zelotes e Lava Jato.
Para dar início às conversas sobre a delação, procuradores exigiram que o petista confirmasse informações sobre o ex-presidente Lula dadas por ex-executivos da Odebrecht, principalmente no diz respeito à conta "Amigo". Ele sinalizou positivamente.
Segundo o ex-presidente da empreiteira Marcelo Odebrecht, Palocci operava uma conta-propina, destinada às demandas políticas de Lula.
Outro episódio que envolve o ex-presidente e que Palocci pretende esclarecer é o suposto benefício financeiro obtido por Lula na criação da empresa Sete Brasil, em 2010.
Até o momento, Palocci se reuniu apenas uma vez com os procuradores. Na conversa, mostrou-se reticente a entregar políticos com foro privilegiado. No entanto, a atitude foi revista depois que investigadores disseram que, sem isso, não haveria acordo.
Depois que foi preso, Palocci colocou um prazo de seis meses para sua defesa antes de começar a negociar uma delação. Como até abril não houve nenhuma decisão de tribunais superiores a favor de sua soltura, deu início às tratativas, comandadas hoje pelos advogados Adriano Bretas e Treacy Reinaldt.

A defesa de Lula afirmou que a Lava Jato "não conseguiu apresentar qualquer prova sobre suas acusações contra o ex-presidente".
A assessoria de Abílio disse que o contrato entre a empresa de Palocci e o escritório de Bastos foi alvo de investigação e não apresentou irregularidades. Diz ainda que, no período de vigência do contrato, Abílio não tinha função executiva na empresa. A assessoria do BTG Pactual não comentou.
